License hearings

Keep driving while the case runs, if the law allows it

After a DUI arrest, the state can suspend your license long before the court case ends. You can ask for a hearing to challenge it, but only within a short window counted in days from the arrest. Miss it, and the suspension usually starts on its own.

We file the request, gather what the officer will rely on, and appear with you at the hearing. If the suspension goes ahead, we ask about a limited permit so you can get to work, school or treatment.

What a license hearing turns on

It’s a narrower question than the criminal case, and it moves faster.

  • The deadline

The request has to be in on time. It’s the first thing we do, often the same day you call.

  • The officer’s paperwork

The form that started the suspension has to be filled in and served correctly.

  • The test or the refusal

Whether the test was offered and given properly, or whether a refusal was really a refusal.

  • A limited permit

If you lose the hearing, a restricted license or an interlock permit may still keep you on the road.

Questions about license hearings

Is the license hearing the same as my court date?

No. It’s a separate proceeding about your license only, usually before a hearing officer, and it can come well before the criminal case.

Can I win the hearing and still be convicted, or the other way round?

Yes. The two run on different rules. That’s why we handle them together, so what happens in one helps the other.

I already missed the deadline. Is it too late?

Call anyway. There may still be a permit or another route to driving, and the criminal case is still ahead.
